Terms and conditions for using Yacht Today Thailand and booking our yacht charter services.

Terms of Service

These Terms of Service govern your use of the Yacht Today Thailand website and any yacht charter, join trip, experience, add-on, or related service booked or arranged through Yacht Today Thailand.

By using this website, submitting a booking request, or making a payment, you acknowledge that you have read, understood, and agreed to these Terms of Service and the applicable policies published on our website.

1. Booking Requests

Submitting a booking request does not automatically guarantee availability or confirm a booking.

All booking requests are subject to yacht availability, schedule availability, operational requirements, and acceptance by Yacht Today Thailand and/or the relevant yacht operator.

Our standard booking process is:

An enquiry, quotation, availability indication, or approved booking request alone does not constitute a confirmed booking.

2. Full Payment Required

Yacht Today Thailand requires 100% full payment to confirm a booking.

A booking is not confirmed until the full required payment has been successfully received and Yacht Today Thailand has issued booking confirmation.

Customers should review all booking details, prices, inclusions, exclusions, additional fees, and applicable policies before completing payment.

3. Booking Hold and Payment Deadline

After a booking request has been approved, the selected yacht or time slot may be temporarily held while the customer completes payment.

The applicable payment deadline or countdown will be displayed or communicated to the customer.

If full payment is not successfully completed before the payment deadline, the temporary hold may expire automatically.

Once the hold expires, availability is no longer guaranteed and the yacht or time slot may become available to another customer.

4. Non-Refundable Payments

All payments are non-refundable once the booking has been confirmed, except where otherwise expressly required by applicable law.

This includes customer cancellations, changes of plans, no-shows, late arrivals, or failure to use part or all of the booked service.

An approved rescheduling does not constitute a refund.

5. Prices, Taxes and Additional Fees

Prices displayed on the website apply to the yacht, package, duration, or service described.

Applicable taxes and additional charges will be displayed or communicated where relevant.

Certain charges may not be included in the advertised yacht charter price.

6. Customer-Requested Booking Changes

After a booking has been confirmed, customers may request changes to booking details, including:

All changes are subject to availability and approval by Yacht Today Thailand and/or the relevant yacht operator.

A requested change is not confirmed until Yacht Today Thailand expressly confirms the revised booking.

If an approved change increases the booking price, the customer must pay the additional amount required.

If a customer-requested change results in a lower price, the difference is not automatically refundable.

7. Weather and Marine Conditions

Yacht charters and marine activities are affected by weather, sea conditions, tides, marine restrictions, and instructions from relevant authorities.

Rain, cloudy weather, or an unfavourable weather forecast alone does not automatically mean that a charter is unsafe or cancelled.

The captain and/or yacht operator has final authority to determine whether it is safe to depart, continue, modify, delay, reroute, or terminate a trip.

If conditions are considered unsafe, the charter may be delayed, modified, rerouted, or rescheduled to another available date where appropriate.

Weather-related circumstances do not automatically result in a cash refund.

Customers should not independently assume that a booking is cancelled because of weather unless Yacht Today Thailand or the relevant operator has confirmed the change.

8. Routes and Itineraries

Routes, destinations, and itineraries displayed on the website are subject to operational and safety conditions.

The captain may change the planned route, destination, anchorage, or activity because of:

The captain has final authority regarding safe navigation and operation of the yacht.

A reasonable route or destination change made for safety or operational reasons does not automatically entitle the customer to a refund.

9. Charter Time and Late Arrival

Customers are responsible for arriving at the designated meeting point at the required time.

Late arrival by the customer may reduce the available charter time.

The charter may still be required to finish at the originally confirmed time due to marina requirements, crew schedules, operational requirements, weather conditions, or subsequent bookings.

Unused charter time caused by customer late arrival is non-refundable.

10. Number of Guests

Customers must provide an accurate number of guests when booking.

The number of guests must not exceed the maximum permitted capacity of the yacht.

Additional guests must be approved before departure and may result in additional charges or fees.

The captain or yacht operator may refuse boarding where the permitted yacht capacity, insurance requirements, or safety requirements would be exceeded.

11. Guest Responsibilities

All guests must behave responsibly and follow reasonable instructions provided by the captain and crew.

Guests must not engage in:

Yacht Today Thailand, the yacht operator, or the captain may refuse boarding or terminate a charter where serious misconduct creates a safety or operational risk.

Where a charter is refused or terminated because of serious guest misconduct, payments will not be refunded.

12. Alcohol and Prohibited Items

Alcohol may be consumed responsibly where permitted by the yacht operator and applicable law.

The captain or crew may restrict alcohol consumption or participation in water activities where intoxication creates a safety risk.

Illegal drugs, unlawful weapons, hazardous substances, and other prohibited items are not permitted onboard.

Serious violations may result in refusal of boarding or termination of the charter without refund.

13. Children and Minors

Children must remain under the supervision of a parent, guardian, or responsible adult throughout the charter.

Parents and guardians are responsible for ensuring that children follow safety instructions.

The captain or crew may require children to wear life jackets or restrict participation in certain activities depending on age, ability, weather, sea conditions, or other safety considerations.

14. Swimming and Water Activities

Swimming, snorkelling, fishing, paddleboarding, water toys, jet skis, and other marine activities are subject to safety conditions and availability.

Participation may be restricted due to:

The captain or relevant activity provider may stop or prohibit an activity where it is considered unsafe.

15. Damage to Yacht or Equipment

Guests must take reasonable care of the yacht, furnishings, equipment, water toys, and other property provided during the charter.

The booking customer may be responsible for reasonable repair or replacement costs resulting from intentional damage, negligence, misuse, or failure to follow reasonable instructions by themselves or members of their group.

Normal wear and tear is excluded.

16. Personal Belongings

Guests are responsible for their personal belongings.

Guests should take particular care of phones, cameras, jewellery, cash, passports, identification documents, and other valuables.

Yacht Today Thailand and yacht operators are not responsible for personal belongings that are lost, damaged, or left onboard, except where liability cannot legally be excluded.

17. Accident Insurance

Where accident insurance is included with an eligible booking, coverage is subject to the terms, conditions, eligibility requirements, coverage limits, and exclusions of the applicable insurance policy.

Accident insurance does not guarantee that every accident, injury, medical expense, activity, or loss will be covered.

Guests may be required to provide accurate passenger information before departure for insurance registration.

Final decisions regarding insurance claims and coverage are made by the relevant insurance provider.

18. Third-Party Yacht Operators and Suppliers

Some yachts, activities, transportation, catering, entertainment, equipment, or other services may be provided by independent yacht owners, operators, or third-party suppliers.

These services may be subject to additional reasonable operational, safety, or service conditions imposed by the relevant provider.

Yacht Today Thailand will endeavour to communicate material booking conditions where applicable.

19. Yacht Availability and Operational Issues

In rare circumstances, a confirmed yacht may become unavailable because of mechanical problems, safety issues, operational circumstances, government restrictions, or other events beyond reasonable control.

Where reasonably possible, Yacht Today Thailand and/or the relevant yacht operator will endeavour to provide an appropriate alternative, which may include:

20. Website Information

Yacht Today Thailand makes reasonable efforts to ensure that yacht descriptions, photographs, specifications, prices, routes, availability, and other information displayed on the website are accurate.

However, minor differences may occur due to maintenance, refits, equipment changes, operational requirements, or updated information supplied by yacht operators.

If a material error affecting a booking is discovered, Yacht Today Thailand will contact the customer as soon as reasonably possible.

21. Service Changes

Yacht Today Thailand and/or the relevant yacht operator may make reasonable changes to a service where necessary because of safety, weather, marine restrictions, mechanical issues, operational requirements, or circumstances beyond reasonable control.

Where a significant change occurs, we will endeavour to provide an appropriate alternative solution where reasonably possible.

22. Limitation of Liability

Nothing in these Terms excludes or limits liability where such liability cannot lawfully be excluded or limited.

To the extent permitted by applicable law, Yacht Today Thailand is not responsible for losses resulting from circumstances beyond its reasonable control, including severe weather, government restrictions, marine restrictions, port or marina closures, or other external events.

23. Privacy and Personal Information

Personal information collected through bookings, payments, communications, passenger registration, or website use will be handled in accordance with our Privacy Policy.

Where necessary to provide the booked service, relevant information may be shared with yacht operators, payment providers, insurance providers, and other authorised service providers.

25. Changes to These Terms

Yacht Today Thailand may update these Terms of Service from time to time.

The latest published version will apply to new bookings made after the updated Terms become effective.

Conditions applicable to an existing confirmed booking will be determined by the terms applicable to that booking, subject to applicable law.
